Terms & Conditions

These Terms & Conditions apply to estimates, proposals, and work performed by Camellia Construction LLC (“Camellia Construction”) unless otherwise agreed to in writing. Acceptance of an estimate or authorization to begin work constitutes acceptance of these Terms & Conditions.

1. Estimates & Scope of Work

Estimates are based on the scope of work described in the estimate and information reasonably available at the time the estimate is prepared. Unless otherwise stated, estimates are valid for 30 days.

Only work specifically described in the estimate is included. Additional work, materials, repairs, modifications, or services not specifically included are outside the original scope and may result in additional charges.

2. Changes & Additional Work

Changes requested by the customer or additional work that becomes necessary after the project begins may result in additional labor and material charges.

Camellia Construction will communicate material changes in scope and anticipated additional costs with the customer before proceeding whenever reasonably practicable. Customer approval of additional work may be provided in writing, electronically, or through another documented form of authorization.

3. Concealed or Unforeseen Conditions

Estimates are based on visible and reasonably observable conditions. Construction and remodeling work may reveal conditions that could not reasonably have been identified before work began.

Examples include, but are not limited to, rot, water damage, mold, pest damage, inadequate framing, structural deficiencies, improperly installed previous work, plumbing or electrical problems, unsuitable substrates, or other concealed conditions.

Unless specifically included in the original scope, labor and materials required to investigate, repair, replace, or otherwise address unforeseen conditions will be treated as additional work.

4. Materials, Finishes & Matching

Material pricing is based on selections, quantities, availability, and supplier pricing known at the time the estimate is prepared. Changes in customer selections, quantities, availability, or supplier pricing may affect the final project cost.

Natural variations in wood, stone, tile, flooring, grout, and other materials are not considered defects.

When repairing or modifying existing construction, Camellia Construction cannot guarantee an exact match of existing paint, stain, texture, wood grain, flooring, grout, tile, aging, weathering, or other finishes.

5. Customer-Supplied Materials

When customers provide materials, fixtures, appliances, hardware, or other products, the customer is responsible for ensuring the items are appropriate, complete, undamaged, and available when needed.

Camellia Construction is not responsible for defects, shortages, incorrect measurements, incompatibility, missing components, shipping delays, manufacturer defects, or warranty issues relating to customer-supplied products.

Additional labor caused by problems with customer-supplied products may be billed separately.

6. Permits & Code Requirements

Unless specifically included in the estimate, permit fees, engineering, architectural services, specialty inspections, and similar third-party costs are excluded.

If permits, inspections, engineering, or additional work are required by a governmental authority or inspector and were not reasonably anticipated or included in the original scope, those costs may result in an adjustment to the contract price.

Camellia Construction will not knowingly perform work in violation of applicable building codes or permit requirements.

7. Scheduling & Delays

Project start dates and completion dates are estimates unless expressly guaranteed in writing.

Schedules may be affected by weather, material availability, supplier delays, inspections, permitting, subcontractor availability, concealed conditions, customer-requested changes, illness, emergencies, or circumstances outside Camellia Construction's reasonable control.

Camellia Construction is not responsible for damages resulting from reasonable delays caused by circumstances outside its control.

8. Customer Responsibilities & Site Access

The customer agrees to provide reasonable access to the project area during scheduled working hours and to remove or protect personal belongings, furniture, valuables, pets, and other items that may interfere with the work unless other arrangements have been made.

Camellia Construction will take reasonable precautions to protect the work area and surrounding property. Construction inherently involves dust, vibration, noise, and temporary disruption.

9. Payment

Deposits and progress payments, when applicable, will be stated in the estimate or invoice.

Unless otherwise stated in writing, final payment is due upon substantial completion of the contracted work. “Substantial completion” means the contracted work is sufficiently complete for its intended use, even if minor punch-list or warranty items remain.

Additional approved work may be added to the final invoice or invoiced separately.

10. Late or Unpaid Balances

Invoices are due according to the payment terms stated on the invoice. Amounts not paid when due may be subject to reasonable collection costs and other remedies permitted by Washington law.

The customer is responsible for reasonable costs incurred by Camellia Construction in collecting amounts lawfully owed, to the extent permitted by applicable law.

Camellia Construction reserves the right to suspend work for materially overdue payments after reasonable notice to the customer.

11. Customer Cancellation

Once an estimate has been accepted and the project scheduled, cancellation may result in charges for work already performed, materials purchased or ordered, non-refundable deposits or supplier charges, permit or administrative expenses, and other project-specific costs already incurred by Camellia Construction.

Any refundable portion of a deposit will be determined after deducting amounts properly attributable to work performed and costs incurred.

Nothing in this section limits any cancellation or rescission rights a customer may have under applicable state or federal law.

12. Final Walk-Through, Acceptance & Punch List

Upon substantial completion of the project, Camellia Construction LLC may conduct a final walk-through with the customer. The customer is responsible for identifying any reasonably observable incomplete, deficient, or unsatisfactory items during the final walk-through or promptly thereafter.

Any items identified during the final walk-through will be documented as punch-list items and Camellia Construction will be given a reasonable opportunity to inspect and, where appropriate, correct those items.

If the customer approves the completed work at the final walk-through without identifying additional punch-list items, the work will be considered accepted as to reasonably observable conditions existing at that time. Customer acceptance does not waive Camellia Construction's one-year workmanship warranty for qualifying defects that were not reasonably observable at the time of the final walk-through.

After acceptance, dissatisfaction based solely on appearance, workmanship, selections, finishes, or other conditions that were reasonably observable and accepted at the final walk-through does not entitle the customer to withhold payment, demand a refund, or unilaterally reduce the agreed contract price.

The customer must provide Camellia Construction with written notice of any claimed workmanship issue and a reasonable opportunity to inspect and, if covered by the contract or workmanship warranty, correct the issue before engaging another contractor or seeking a credit, refund, or reduction in the contract price.

Minor punch-list or warranty items do not constitute grounds for withholding the entire outstanding contract balance. Payment remains due in accordance with the agreed payment terms, subject to any rights that cannot be waived under applicable law.

13. Workmanship Warranty

Camellia Construction warrants its workmanship for one (1) year from the date of substantial completion.

If a defect resulting directly from Camellia Construction's workmanship is reported during the warranty period, Camellia Construction will, at its discretion, repair or correct the affected work at no additional labor charge.

The customer must provide Camellia Construction a reasonable opportunity to inspect and correct an alleged workmanship defect before arranging for repairs by another contractor.

The workmanship warranty does not cover normal wear and tear; abuse or misuse; failure to maintain the property; damage caused by occupants, pets, pests, or third parties; structural movement or settlement; water or moisture intrusion unrelated to Camellia Construction's work; weather or acts of nature; modifications or repairs performed by others; pre-existing conditions; or failure of products or materials not caused by improper installation.

The workmanship warranty does not cover defects, failures, or damage caused in whole or in part by pre-existing conditions or by existing materials, systems, components, or construction not installed by Camellia Construction LLC.

Manufacturer warranties, when applicable, remain subject to the manufacturer's individual terms. Customer-supplied products and materials are not warranted by Camellia Construction, although workmanship associated with their installation remains covered to the extent the issue results directly from Camellia Construction's installation.

14. Existing Conditions & Adjacent Finishes

Camellia Construction LLC is not responsible for defects, deficiencies, damage, deterioration, code violations, improper installation, or other conditions that existed prior to the commencement of Camellia Construction's work or that are unrelated to the work performed by Camellia Construction.

This includes, but is not limited to, pre-existing water or moisture intrusion, rot, mold, pest damage, structural movement or deficiencies, inadequate framing or substrates, plumbing or electrical issues, previous repairs or installations, aging or deteriorated materials, and work performed by previous contractors or property owners.

Camellia Construction is not responsible for damage, failure, or other issues that arise from, are caused by, or are materially contributed to by a pre-existing condition, even if the condition becomes apparent during or after Camellia Construction's work.

If a pre-existing or concealed condition is discovered that may affect the contracted work, Camellia Construction may stop or modify the affected work until the condition can be evaluated and, if necessary, corrected. Any investigation, repair, replacement, or additional work required to address such conditions is outside the original scope unless specifically stated otherwise and may result in additional charges.

When Camellia Construction performs repairs, alterations, or installations involving existing construction, Camellia Construction will use reasonable care but cannot guarantee the condition, performance, longevity, or code compliance of existing materials, systems, assemblies, or work that Camellia Construction did not install.

Camellia Construction's one-year workmanship warranty applies only to workmanship performed by Camellia Construction and does not extend to failures or damage caused by pre-existing conditions or existing components.

15. Subcontractors

Camellia Construction may use appropriately qualified subcontractors or specialty trades to perform portions of the work.

16. Photographs

Camellia Construction may photograph work before, during, and after construction for project documentation, estimating, warranty, and business-record purposes.

Photographs that identify the customer, personal information, or the property's specific address will not be used for public marketing without permission.

17. Washington Consumer & Lien Notices

Customers will be provided any disclosures or notices required by applicable Washington law.

Nothing in these Terms & Conditions waives or limits rights or obligations that cannot legally be waived under Washington or federal law.

18. Entire Agreement

The accepted estimate, approved change orders or additional-work authorizations, and these Terms & Conditions constitute the agreement between the customer and Camellia Construction regarding the described work.

Any material modification should be documented in writing.

19. Governing Law

These Terms & Conditions and work performed by Camellia Construction are governed by the laws of the State of Washington.
